COMMON QUESTIONS

Before You Use Your Review Plan

Does a category match mean FMCSA will approve my request?

No. A match means your answers appear consistent with a category. FMCSA reviews the evidence and decides whether a crash was Not Preventable, Preventable, or Undecided. This planner does not assign fault or a probability of success.

What happens after a Not Preventable determination?

The crash is excluded from the Crash Indicator BASIC calculation and receives a notation on PSP. The crash is not erased. A determination does not decide legal liability or guarantee insurance, employment, or safety-rating outcomes.

What if I do not have the police report yet?

You can prepare and save a plan, but the police accident report is required for a submission. The crash must also be available in FMCSA’s records for selection in DataQs.

Which rules does this tool use?

The planner uses FMCSA’s December 2024 expansion for crashes on or after December 1, 2024, and the earlier criteria for older crashes. Crashes more than five years old cannot be reviewed. Guidance was checked October 25, 2026.
